Crisis management plan (CMP) is a measure of readiness to meet uncertainties and future risks and accidents. If we have a good crisis management plan at place, we can minimise the damage and harm to maximum possible extent.

CMP pertaining to information and communication technology (ICT) is an essential part of national ICT policy of India. The other parts of national ICT policy of India are cyber security policy of India, critical infrastructure protection policy of India, critical national infrastructure protection policy of India from cyber attacks, national security policy of India, etc.

Similarly, we must also formulate a cyber security policy for India. With more and more networks and computers are now connected with public utilities and essential public services, cyber security assumes great significance these days. India is also looking forward for mandatory electronic delivery of services. This would increase the risks of cyber attacks upon crucial public delivery systems of India.

Parliamentary Oversight Of Intelligence Agencies Of India Is Needed

Indian Government is not willing to understand and accept that Intelligence Work is not an excuse for Non Accountability.

For some strange reasons Intelligence Infrastructure of India has become synonymous for Non Accountability and Mess. There is neither any Parliamentary Oversight nor and Transparency and Accountability of the working of Intelligence Agencies of India.

India does not have any “Lawful Interception Law”. All it has is the “Unconstitutional” provisions of the Information Technology Act 2000 (through IT Act 2008 Amendments). Through these amendments, the Cyber Law of India has been made an “Instrumentality” of e-surveillance in India. There are no procedural safeguards that can prevent the illegal and unconstitutional e-surveillance activities in India.

International Cyber Crime Treaty And Indian Response

In this article on international cyber crime treaty and India, the author has very aptly discussed the issues pertaining to harmonisation of international cyber crime law. Indian response to the EU convention on cyber crimes has been in negative and India is still not a party to the convention.

We have neither a cyber crime policy in India nor a cyber law policy in India. Naturally, signing of an international cyber crime treaty by India is not foreseeable in the near future. Despite the efforts of EU and United Nations, cyber law is still governed by national laws.

Encryption Laws And Regulations In India

Till now encryption is an unresolved enigma in India. For some strange reasons, encryption is a feared technology in India. Is Online Banking System Of India Cyber Secure?

Cyber security for banking and financial sectors of India is urgently required as they perform very crucial functions. Realising the necessity of ensuring cyber security for these sectors, the Reserve Bank of India (RBI) has in the past constituted a working group on information security. RBI issued a “notification” asking the banks of India to comply with its recommendations.

As per RBI’s recommendations, all banks should create a position of chief information officers (CIOs) as well as steering committees on information security at the board level at the earliest. However, banks of India have shown no willingness to incorporate cyber security into their day to day functions. Till now the directions of RBI to appoint CIOs and steering committee has not been followed by banks of India. The recommendations of the RBI have still not been implemented. Naturally, Indian banks are poor at developing cyber security policies and implementing the same.

Data Protection Laws In India

The statutory aspects of data protection in India are scattered under various enactments. The Information Technology Act 2000 (IT Act 2000), which is the cyber law of India, also incorporate few provisions regarding data protection in India. However, till now we have no dedicated statutory and constitutional data privacy laws in India and data protection law in India.

Further, we do not have a dedicated privacy law in India as well. Privacy rights in India are still not recognised although the Supreme Court of India has interpreted Article 21 of Indian constitution as the source of privacy rights in India. Just like data protection, provisions pertaining to privacy laws in India are also scattered in various statutory enactments. Privacy rights and laws in India need to be strengthened keeping in mind the privacy rights in India in the information age.

Google Defeating Copyright Rights In India And US

Of late, Google has been openly defying the copyright laws of India and US. For instance, Google has been denying removing copyright violating search results from its search engine results despite a clear DMCA notice in this regard.

In fact, Google has been deleting the original posts and copyrighted articles when it is required to delete the search results of the copyright infringer.

Thankfully the an Australian  court has put brake to this arbitrary, rather illegal, act of Google and has imposed a fine upon it for  not removing defamatory material from its search results.

This behaviour of Google must be taken seriously as Google is clearly acting against various laws and needs to be punished accordingly.

In an order that is both embarrassing and eye opener for Google, an Australian court has held Google liable for publication of defamatory images. Although Google tried to use its favourite trump card of being an online service provider (OSPs) yet it failed to realise that it cannot enjoy safe harbour immunity if it do not comply with its conditions.

The cyber laws and cyber security trends of India 2011 by Perry4Law and Perry4Law’s Techno Legal Base (PTLB) has clearly showed the cyber security vulnerabilities of India.
